FELA is...

The late 1800s and early 1900s was a time of great expansion for the railroad but the growth came with a price. Thousands of railroad workers were killed or seriously injured while working on the railroad. The U.S Congress responded to the crisis and created the Federal Employers Liability Act to help railroad workers injured on the job. Injured railroad workers could seek compensation from their employer if the railroad caused the injury.

FELA Coverage

FELA was set up to hold common carriers by railroad accountable for injuries and death resulting from the negligence of any representatives or employees of the railroad or if railroad cars, engines, appliances, machinery, tracks, roadbeds, or other equipment injure a worker. The injured worker must show negligence on the part of the railroad, which in simple terms means the railroad failed to use reasonable care.

The injured employee need only show the injury was caused, in whole or in part, by the negligence of the railroad through the negligent conduct of another railroad employee, representative, or equipment. If the injured worker was partly at fault, the recovery is reduced proportionately by how much the worker was at fault. Who was at fault and by how much is a question for the jury in either state or federal court.
